Sexual Harassment Legislation in India

India is attempting to put into place what will be their first legislation to stop the sexual harassment of certain working woman. The legislation would only include women working in the organized sector of India's work force, which includes factories, hotels, airlines, textile mills, parts of the farm sector and offices. However, out of the hundreds of millions of working women in India, only 1.5 million are considered part of this formal sector.

" The proposed law, which parliament will review when it resumes later this month, states "gestures of a sexual nature whether verbal, textual, physical, graphic or electronic" are "unwelcome conduct." Although, the law will only cover a select few, that sector is rife with sexual harassment. Men's groups are not exactly for this improvement, claiming that Indian women will exploit the legislation to further their careers. Clearly, there is much work to be done.

Originally posted at InjuryBoard by Rick Patterson

Sexual Harassment in the Armed Forces

Sexual harassment is widespread in the United States and abroad. Unfortunately, that is also the case within the armed forces. That is why Colleen Mussolino has spoken to many on the subject. This Wednesday, she will speak at the Pentagon in Washington, D.C. on women in the military and care for those suffering from Post Traumatic Stress Disorder caused by sexual harassment, rape and intimidation. When discussing the topic, she recently stated "We knew that the women would be in more precarious situations than ever before. We knew that they would need help like never before."

When she speaks before the Pentagon, Mussolino will be asking to have the Department of Defense and Congress to change the Uniform Code of Military Justice. Her hope is that there will be more avenues for victims. Including the ability to hold the perpetrators responsible for their offences. Mussolino added "Men are raped too. "It isn't just the women." It is difficult for many to fathom the emotional and physical turmoil that the men and women of the armed forces are put through. To add sexual assault to their burden is unconscionable.

Originally posted at InjuryBoard by Greg Owen

New Rules Against Sexual Harassment

New rules could be adopted regarding sexual harassment on Monday's American Bar Association meeting. The rules, which were last revised in 1990 would spell out that judges are to avoid "sexual advances, requests for sexual favors" and other such unwelcome behavior.

Ethics and women's groups pushed for even more specific language, but said they welcome special recognition of a problem they say persists to a disturbing degree.

According to Lynn Hecht Schafran, director of the National Judicial Education Program, the additional rules are necessary because "the things that go on are quite astounding." Some ethics experts have said that the new rules (pertaining to sexual misconduct) do not go far enough in reining in expense-paid trips for judges and their spouses to legal seminars.

It is disturbing to think that according to the American Judicature Society, a nonpartisan ethics group made up mainly of lawyers and judges, approximately 70 state judges have been disciplined publicly for sexual harassment since 1990.

Originally posted at InjuryBoard by Rick Patterson

MySpace Involved in Legal Action

It has long been advised that parents pay serious attention to what their children are doing and who they are interacting with while on a computer.

MySpace, the popular Internet social network, has become very popular, particularly with teens. Of late, the families of five teenaged girls who were sexually assaulted by predators they met while on MySpace, have sued the owner 'News Corp.' for negligence and fraud. The cases were filed Superior Court in Los Angeles on Wednesday.

The minimum age to register on MySpace is 14. Last year the service arranged it so that members who are 18 years or older could not contact 14 to 15-year-olds unless that already knew the younger member's e-mail address. The company is also in the process of adding new software to allow more parental control.

Originally posted at InjuryBoard by Rick Patterson

No Charges for Orange County Sheriff

After conducting a criminal investigation involving Orange County Sheriff Michael Corona, California attorney general's office has determined that no sexual harassment charges will be filed.

Michael Corona denied all charges and asked the attorney general's office to investigate the allegations. It seems that in 2004 Michael Corona fired ex-Assistant Sheriff George Jaramillo. The current investigation was brought on by complaints of sexual harassment made by female relatives of Mr. Jaramillo. One case was deemed to be without merit while the other could not be confirmed. Jaramillo is currently awaiting trial on corruption and other charges.

Originally posted at InjuryBoard by Greg Owen
