In January 29, 2003, Michael Simmons, 28, was stopped by state trooper, John Hayes for running a red light. During that traffic stop, Simmons' teen-age cousin gave false information to the trooper in the form of conflicting names and was subsequently arrested.

Once Simmons' cousin was arrested, Simmons thought it best to flee from the trooper. As a result, the trooper fired 11 shots 7 of which hit Simmons, who died shortly thereafter. Ellington testified this week that at the time of the incident he feared for his life. He was cleared of wrongful death charges on Friday by a federal jury.
