President Bush had named National Association of Manufacturers' lobbyist Michael Baroody to head the commission, which oversees product recalls. That commission also aids in enforcing federal consumer safety rules. Fortunately, there is strong opposition from many including Senators Bill Nelson, Dick Durbin and Barack Obama. Senator Nelson stated to Baroody that his nomination was similar to nominating a drug industry lobbyist to head the Food and Drug Administration.

While addressing the issue regarding Baroody with USA today, Senator Nelson said "He did not seem to understand the potential conflict." Apparently, Bush didn't either. Whitehouse spokeswoman Emily Lawrimore stated that President Bush accepted Baroody's decision and added "After some members of the Senate rushed to judgment about Mr. Baroody and his qualifications, it became evident to Mr. Baroody that he would not be confirmed."
